Welcome to YardHQ, a service operated by TeamThinkTank ("Company," "we," "our," or "us").

By accessing or using the YardHQ website, mobile application, or related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service.

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.

YardHQ provides AI-assisted tools, recommendations, plant and yard identification features, organizational tools, and related landscaping and horticultural guidance.

You agree to:

By uploading or submitting User Content, you grant TeamThinkTank a non-exclusive, worldwide, royalty-free license to:

• and use such content solely for operating, improving, and providing the Service.

This includes the use of uploaded photos for:

• AI-based identification,
• recommendations,
• feature improvement,
• troubleshooting,
• and service optimization.

You represent and warrant that:

• you own or have permission to use all uploaded content,
• your content does not violate any law or third-party rights,
• your content does not contain unlawful, abusive, or malicious material.

We reserve the right to remove User Content that violates these Terms.

You agree not to:

• use the Service for unlawful purposes,
• upload harmful code, malware, or viruses,
• interfere with or disrupt the Service,
• attempt unauthorized access to systems or accounts,
• scrape, reverse engineer, or exploit the Service,
• use automated systems to overload the platform,
• impersonate another person or entity,
• upload offensive, illegal, or infringing content.

We may suspend or terminate accounts that violate these Terms.

YardHQ uses artificial intelligence and automated systems to provide recommendations, identifications, and guidance.

AI-generated information may:

• be inaccurate,
• incomplete,
• outdated,
• or inappropriate for specific circumstances.

The Service is provided for informational and convenience purposes only and does not constitute professional landscaping, horticultural, botanical, agricultural, legal, financial, or safety advice.

You are solely responsible for verifying information before making decisions affecting property, plants, safety, finances, or landscaping outcomes.

Certain features may require a paid subscription.

By purchasing a subscription, you authorize us or our payment providers to charge your selected payment method.

Subscriptions may automatically renew unless canceled prior to renewal.

Payments processed through:

• Google Play,
• Apple App Store,
• Stripe,
• or other third-party providers

are additionally governed by those providers' terms and policies.

Unless otherwise required by law or platform policy, subscription fees are non-refundable.

You may cancel your subscription at any time through your account settings or the applicable app marketplace.

The Service, including all software, branding, logos, designs, text, graphics, AI systems, and functionality, is owned by TeamThinkTank or its licensors and is protected by intellectual property laws.

You may not:

• copy,
• reproduce,
• distribute,
• modify,
• reverse engineer,
• or commercially exploit

any portion of the Service without written permission.

The Service may contain integrations or links to third-party websites or services.

We are not responsible for:

• third-party content,
• third-party policies,
• availability,
• accuracy,
• or practices.

Your use of third-party services is at your own risk.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by law, TeamThinkTank disclaims all warranties, express or implied, including:

• merchantability,
• fitness for a particular purpose,
• non-infringement,
• reliability,
• availability,
• and accuracy.

We do not guarantee uninterrupted or error-free operation of the Service.

To the fullest extent permitted by law, TeamThinkTank and its affiliates shall not be liable for:

• exemplary,

• plants,
• landscaping outcomes,

arising from your use of the Service.

Our total liability shall not exceed the amount you paid to use the Service during the twelve (12) months preceding the claim.

• abusive conduct,
• fraudulent activity,
• security concerns,
• or misuse of the platform.

Termination may result in removal of User Content and loss of access to features.
